How to make an appeal?

Appealing is a simple process that can be done online or by post.

To appeal a decision made in mediation or adjudication, applications can be made online. The cost for an appeal application on line is €85.

To submit an application to appeal by post, the cost is €100. The completed form, along with the fee of €100, should be sent by post  to the Residential Tenancies Board, PO Box 47, Clonakilty, County Cork.

Please note an appeal can not be emailed or faxed. To lodge a valid appeal/referral the fee must accompany the complete documentation and be on time.

An appeal must be within the correct time period

  • Adjudication - One or more parties may apply/appeal to a Tenancy Tribunal within 10 working days of receipt of the Adjudication Report. Please note though that where an agreement is reached at adjudication the ‘cooling off’ period is 10 calendar days from the date the agreement was made and if one or either of the parties wishes to refer the case to a Tenancy Tribunal they must do so within the 10 calendar day cooling off period.
  • Mediation – One or more parties may apply/appeal to a Tenancy Tribunal within the 10 calendar day (this includes Saturdays, Sundays and Bank Holidays) “cooling off” appeal period from the date an Agreement was reached or from the date the mediation ceases
