Dispute resolution services and the RTB

A very small proportion of all tenancies end up in dispute. There are a number of ways to avoid problems and resolve disputes if they arise.

A good understanding of your rights and responsibilities can help avoid problems. Many problems that arise come from landlords and tenants being unclear about what each is responsible for.  

If a problem arises, clear and early communication can help resolve the matter. However, if this is not possible, the RTB offers dispute resolution services to registered landlords, tenants and third parties (such as a neighbour) who require assistance in resolving an issue. If you are a neighbour, you must first talk with the landlord and tenant to try and resolve your complaint before you lodge a dispute application.

Role of the Residential Tenancies Board in resolving disputes

The RTB has replaced the Courts for landlord and tenant disputes and has a quasi-judicial role with many of the powers of the Courts. However, the way we resolve disputes is less formal. For instance, you do not need legal representation to make a complaint to the RTB nor do you need to have legal representation at a hearing.

Landlords and tenants have a number of options to resolve a dispute. Our dispute resolution procedures are also quicker than those of the courts. This means resolving a dispute should be relatively simple, inexpensive and straightforward.

The RTB remains strictly impartial and does not provide advice to either party in dispute beyond general information.
